Privacy Statement
1) Introductory provisions
By accessing and using the Jamnica website the Users confirm that they have read, understood and agreed to the Statement on privacy and confidentiality of data (hereinafter: Privacy Statement) as well as terms and conditions of using the Jamnica website. The Users which do not accept these terms and conditions in full, should leave the Jamnica website immediately and refrain from using it again.
2) Privacy Statement Revision
Jamnica is authorized to modify the Privacy Statement at any time by posting a revised text on the Jamnica website. Such changes and/or modifications shall become effective immediately upon the posting thereof on the website. Any use of the website by the End User after such notice shall be deemed to constitute acceptance by the End User of such modifications.
The User is obliged to periodically review our Privacy Statement to become and remain familiar with it. The User will be deemed to have accepted any modifications to the Privacy Statement if they continue to use the website after they have been posted. We will not be liable for any damage caused to the users, registered users or third parties due to such changes.
3) Type and Use of Collected Information
Jamnica collects personal information that identifies website Users. When the User participates in certain activities on the Jamnica website, such as opening an account, subscribing to a newsletter, posting content and/or publishing articles on forums, participating in contests organized by Jamnica, filling out a survey, posting comments, sending feedback to Jamnica, searching for information about Jamnica products and services and posting videos, Jamnica may require the User to provide certain personal information. The User is not required to engage in these activities. If the User decides to engage, Jamnica is authorized to ask for personal information: first and last name, address (including postal code), email address, phone number, date of birth and a photo.
Jamnica is authorized to use such personal information to offer you products and services, organize contests, enhance website functionality, improve advertising and promotional efforts, analyze website usage, improve the offer of Jamnica products and services and to gather your experiences with third parties. Jamnica is explicitly authorized to use comments from Users in order to notify other users about their products and services. Such comments can be published in Jamnica advertising materials on the website. Further, if you are using Jamnica website to send information or products to other persons, Jamnica is authorized to save personal information from the User and recipient. Jamnica is authorized to use personal information of the User for troubleshooting problems, executing administrative tasks, establishing contacts, honoring agreements, including the Terms and Conditions of Use and the Privacy Statement of the Jamnica website, complying with relevant laws and cooperating with law enforcement services.
Jamnica is authorized to collect information that does not identify a specific End User, including the Uniform Resource Locator (URL) of the website the User visited before coming to the Jamnica website, URL of the website which the User visited after leaving the Jamnica website, type of browser the User is using and the Internet Protocol (IP) address of the User. The authorized service providers and advertisers can automatically gather such information while visiting Jamnica website via “cookies” and other tools. Jamnica uses such information solely to troubleshoot problems, administrate the website, analyze trends, gather demographic data, and analyze compliance with valid regulations and cooperation with law enforcement services.
Depending upon the activity, some information is identified as mandatory, and some as voluntary. If the User does not provide the mandatory data with respect to a particular activity, they may not be able to engage in that activity. Jamnica will not collect personal information via its website, (e.g. first and last name, address, phone number or email address), unless the User voluntarily chooses to provide us with it (e.g. by registration, survey), respectively, provides their consent, or unless otherwise permitted by applicable laws and regulations for the protection of personal data.
4) Disclosure of Personal Information
Jamnica will not share Personally Identifiable Information with other parties, but may share information about Users with other members of Jamnica Group.
Jamnica provides certain services and products through third parties. These “Third Party Service Providers” perform different functions on behalf of Jamnica such as sending administrative and promotional emails. Jamnica may share the User’s personal information with such Service Providers to fulfill orders, deliver packages, send mail and emails, administer contest, remove repetitive information from customer lists, analyze data, provide marketing assistance, provide search results and links, process credit card payments, operate the website, troubleshoot and provide customer service.
Jamnica is authorized to disclose information about the User in order to protect Jamnica and others. Jamnica is authorized to disclose Personally Identifiable Information of the User when it is justified to expect that the disclosure will help in law enforcement or is ordered by the court, to ensure compliance with this Privacy Statement, the Terms and Conditions of Use of the Jamnica website or other agreements; or to protect property rights or safety of this website, its Users or others.
If the User chooses not to have their personal data used to support Jamnica’s relationship with business partners and clients (especially direct marketing or market research), Jamnica will respect the User’s choice. Jamnica does not sell or otherwise market Personally Identifiable Information to third parties, except to Jamnica’s affiliates.
5) Updating and Correcting Information
The User is authorized to change any personal information by sending an email message or changing the profile. The email message must specify the User’s first and last name, address and email address, and information that are to be updated. The User can always request to have the information about their account permanently deleted or removed. The User is informed that Jamnica cannot delete information associated with past transactions on the Jamnica website.
6) Data Protection
Jamnica uses technical and organizational security measures to protect personal data against accidental or unlawful destruction, loss or alteration and against unauthorized disclosure or access.
The User can access personal information on Jamnica website using password and email address. The User is advised not to disclose any passwords to a third party. The User is familiar with the fact that no data transmission over the Internet or any wireless network can be guaranteed to be perfectly secure. Although Jamnica takes all commercially reasonable measures to secure and protect information, it cannot guarantee the security of any information transmitted to or from our website and is not liable for the actions of any third party that receives such information.
7) Monitoring Data
Jamnica is authorized to store cookies with the User’s information on the computer. They are used for saving the User’s time when returning to the Jamnica website, monitoring and directing the User’s interest to provide services customized to fit the needs of every User. Cookies also collect non-personal information from visitors. Jamnica uses third-party advertising companies to serve ads on Jamnica website. As part of their service, they may place separate cookies on your computer. Jamnica has no access to, or control over these cookies. The User can choose to disable cookies by changing settings within the browser. If the User chooses not to allow cookies, some parts of the website may not work properly. Jamnica may use other standard technology for monitoring the use of the website and promotion, and may allow third party service providers to use these methods on behalf of Jamnica.
8) Non-disclosure of Information for Third Party Websites
This Privacy Statement applies only to the use and disclosure of information Jamnica collects from the Users. Other websites which can be accessed via Jamnica website have their own statements on confidentiality and data collection and their use and disclosure of such information. Jamnica is not responsible for the operation or for the content, privacy policies, or security of, third party sites.
9) Minors
Minors may participate in promotional activities, only and exclusively with the consent from their parents, guardians or custodians. Jamnica will not knowingly collect or keep information – personal data from children under the age of 14, without insisting that they seek prior parental consent if required by applicable law. Jamnica will only use or disclose personal data of children to the extent permitted by law, to seek parental consent pursuant to local law and regulations or to protect a child.
10) Privacy Statement Application
This Privacy Statement shall be effective from 1 July 2017 until revocation by Jamnica.
